Terms of Service

These Terms of Service ("Terms") are an agreement between you and Idmod Labs LLC, a Wyoming limited liability company, 30 N Gould St, Ste N, Sheridan, WY 82801, United States ("Idmod Labs", "we", "us"). They govern your use of the website at idmodlabs.com (the "Site"). Notices to us may be sent to legal@idmodlabs.com.

By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Our apps have their own terms. Each app we publish is governed by the terms of service shown in that app and its store listing. If those terms conflict with these Terms, the app's terms apply to that app.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• interfere with or disrupt the Site, its servers or networks, or attempt to gain unauthorized access to them;
• use automated means to access the Site in a way that places an unreasonable load on it;
• use the Site to send spam, malware or other harmful content;
• copy, reproduce or redistribute the Site's content except as allowed by law or by these Terms.

2. Our intellectual property

The Site and its content, including its text, design, graphics, logos and the "Idmod Labs" name, belong to us or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to view the Site for your own non-commercial purposes. App names and logos shown on the Site are our trademarks or those of their respective owners. Apple, App Store, Google Play and Android are trademarks of their respective owners; their appearance does not imply endorsement.

If you send us feedback or suggestions, we may use them without any obligation to you.

3. Third-party links and services

The Site may link to third-party websites and services, such as the Apple App Store and Google Play. Your use of them is governed by their own terms and privacy policies, and we are not responsible for their content or practices.

4. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT ITS INFORMATION IS COMPLETE OR UP TO DATE.

5. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, IDMOD LABS AND ITS MEMBERS, MANAGERS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, such as liability for fraud, or your mandatory rights as a consumer in your country.

6. Indemnity

To the extent allowed by law, you agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or the law. This does not apply to consumers where such an obligation is not permitted.

7. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wyoming. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in your local courts. Before filing a claim, please contact us at legal@idmodlabs.com so we can try to resolve it informally.

8. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. If you keep using the Site after a change takes effect, you accept the new Terms.

9. General

These Terms, with the Privacy Policy, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in a merger, acquisition or sale of assets. If a translation of these Terms conflicts with the English version, the English version prevails, unless local law requires otherwise.
